San Juan, PR – May 8, 2026 – The Financial Oversight and Management Board for Puerto Rico today issued the following statement:
The Oversight Board understands that the U.S. District Court for the District of Puerto Rico remanded the Puerto Rico Government’s lawsuit against LUMA Energy to the Puerto Rico local courts. The continuation of electric service is critical for the people and businesses in Puerto Rico and any dispute between the Government and the private operator must not affect the maintenance and modernization of the energy system, the reconstruction of the grid, and the flow of federal funds.
The management of PREPA’s grid and power generation by private operators is a requirement of Puerto Rico Act 120-2018 and the PREPA Fiscal Plan. Every administration of the Government of Puerto Rico has recognized the involvement of private-sector expertise as critical. Any change in operators must follow a transparent and competitive process.
